Summary

Rupert has a diverse practice which includes defending in all aspects of criminal law with an emphasis on fraud, in extradition, and sports law including contractual disputes, disciplinary tribunals and arbitrations.

Judicial review in the developing area of challenging search warrants, and unlawful arrest and detention has become an area of specialism.

He is currently working on a judicial review of the detention of those arrested for acts of terrorism in Operation Pathway More>

He has recently been given permission by the Divisional Court to challenge the retention of DNA on the police national database of individuals arrested but never convicted of a criminal offence, he also acts for Vladislav Dudko in extradition proceedings brought by the Russian Federation. That case is pending appeal before the High Court to determine whether Mr Dudko’s human rights will be violated if returned to Russia to face trial. It is expected to be a leading decision.

The successful challenge to a search of a forensic computer expert led to the refusal of the Chief Constable to return Mr. Bates’ property following the High Court ruling. Eventually this led to an application to commit the Chief Constable to prison whereupon the property was returned the evening before the court hearing. More>
